Violência doméstica contra a mulher, práticas jurídicas e impunidade penal em Moçambique
Domestic violence against women, legal practices, and criminal impunity in Mozambique

This study analyzes domestic violence against women in Mozambique as a structural, multidimensional, and historically conditioned phenomenon, influenced by sociocultural, economic, institutional, and legal factors. The central issue lies in the persistence of criminal impunity and the limited effectiveness of Law No. 29/2009, the implementation of which faces “significant obstacles, such as a lack of human and material resources, procedural delays, and limited training for justice system professionals.” The study proceeds from the hypothesis that, despite legislative advances, patriarchal practices, gender inequalities, and institutional weaknesses continue to hinder the holding of perpetrators accountable and the protection of victims. The objective is to identify gaps in the application of the law, understand the sociocultural factors underpinning violence, and analyze how state actions contribute to the persistence of impunity. Methodologically, the research adopts an exploratory qualitative approach based on a literature review, document analysis, and empirical studies, enabling an examination of patterns of violence, recidivism, underreporting, and regional disparities. The results reveal that patriarchal norms, economic dependence, the stigmatization of victims, and fear of reprisals “reinforce silence, hinder reporting, and perpetuate the cycle of violence,” particularly in rural areas. The study concludes that criminal impunity stems from the interplay of institutional weaknesses, a lack of specialized services, fragmented public policies, and sociocultural barriers, necessitating integrated responses that strengthen the justice system, expand protection mechanisms, and foster cultural transformations capable of ensuring dignity, safety, and equal rights for Mozambican women.
